My husband has passed away he owns land in Monchique, which he inherited from his mother.  We engaged the services of a lawyer to transfer the title into his name, after 2yrs and £4,500 in fees this was not completed correctly due to an error on the Cadastre. Albeit my husband regularly paid the rates bill issued to him in his name by the Camara.  A Portuguese colleague of mine said lawyers were not needed and that in my case I should take his death certificate to the Camara and they would transfer the ownership to myself.

I'm currently in a position whereby I cannot afford costly fee's or flights to Portugal without understanding what I can do on my own or the need for a lawyer.

My husband did not make a Portuguese will; he did make an English one which distributed his English assets but made no mention of the land in Portugal, our English lawyer for purposes of Inheritance Tax has declared it as mine as his spouse.

I would really appreciate it if anyone could advise me; or even provide an English speaking contact at Monchique Camara for people in situations such as mine.  Many thanks for your time.

Hi, I transferred my mother's home to me on her death using a Monchique lawyer for I think 2000 euros. I may be selling the property this year. The proof of the validity of the transfer will be the success of the sale! I have deeds showing the house in my name so I am pretty confident. My mother had no portuguese or UK will. It was quite straightforward as I was her only child and there was no spouse. If you want to know my Monchique solicitors name please let me know. It's all so worrying as well as being so sad.
